This is error to review a judgment of the circuit court for Milwaukee county finding the plaintiff in error, Hugh Edward Flowers,
guilty of indecent behavior with a child in violation of sec. 944.11 (2), Stats. At the time of the offense, Sandra --- was sixteen years old. Although she ordinarily lived with her father in northern Wisconsin,
she was, in July of 1965, visiting with her mother, Dorothy. Sandra's mother was living with the defendant, although she was
not yet married to him. On the evening in question the defendant drank heavily. He and two other persons drank four fifths
of vodka. Shortly after midnight, Flowers left the house to drive his friend, George Tate, home. There was testimony by Dorothy
Flowers (a marriage had taken place between the incident and the time of trial) that Flowers had left without his shoes, that
he was staggering, and that he had to be helped through the door. Sandra testified, however, that during the entire evening
Flowers gave no evidence of intoxication, although she recognized that he had been drinking. After dropping off Tate, the
defendant, over the protests of Sandra, drove to a spot in the city of Milwaukee near the sewage disposal plant. He parked
there and told her to remove her Bermuda shorts. When she refused, he grabbed her by the neck and pushed her backwards. She
flipped entirely over the front seat, landing on the floor in front of the rear seat. The defendant crawled over the seat,
grabbed her by the throat, and forcefully removed her Bermudas and undershorts. He insisted on having relations with her.
Sandra testified that when she refused, he nevertheless committed the act of cunnilingus.
